WAIVER OF LIABILITY AND INDEMNIFICATION

FOR TEST DRIVE WITH A LIVEWIRE MOTORCYCLE

I, the undersigned, have the opportunity to participate in a free test ride (as a rider or passenger) on one or more LiveWire® motorcycles (each of which is referred to herein as a "motorcycle"). I understand and acknowledge that operating or riding a motorcycle is an activity that involves risk.

In consideration of this activity, I, the undersigned, on behalf of myself and my heirs, personal representatives, administrators, executors, successors and assigns (collectively, "Heirs and Agents"), and on behalf of my fellow riders, do hereby release LiveWire Germany GmbH ("LiveWire"), all of its affiliates within the meaning of §§ 15 et seq. AktG (collectively, "Affiliates"), and all officers, directors, employees, dealers, distributors, and agents of LiveWire and the Affiliates (collectively, the "Released Parties") from any and all claims, demands, rights, and causes of action (collectively, "Claims") of any kind that I or any of my heirs and assigns, or my fellow Riders, may later have against any Released Party,

· except in the case of intent or gross negligence on the part of the Indemnified Parties,

· except in case of liability of the Indemnified Parties under the Product Liability Act,

· except in case of breach of a cardinal obligation by the Indemnified Parties - cardinal obligations in the aforementioned sense are such obligations which are essential for the proper performance of the contract and on the observance of which the contracting parties may typically rely -,

· except in the case of injury to life, limb or health resulting from a negligent breach of duty by the user or an intentional or negligent breach of duty by a legal representative or vicarious agent of the user.

This agreement is subject to German law.
